$4,750,000 – Age/Gender Discrimination

Verdict in Anderton v. Bass Underwriters Inc. on behalf of a 61 year old underwriter for Bass Underwriters who was unfairly terminated from her employment in favor of a younger male colleague. Anderton received “pushback” from Bass Underwriters after she recommended a female coworker for a promotion in her office, largely occupied by men. Following this incident, male executives began to make comments about Anderton’s age and pressured her to retire, and was eventually terminated.

$1,475,000 – Retaliation for use of FMLA/CFRA leave

Verdict in Hazzard v. Raley’s Family of Fine Foods, Inc., et al. on behalf of a pharmacist, who was terminated for violation of company pharmacy policies. Raley’s claimed that Plaintiff was terminated for filling prescriptions and ringing himself up (zero co-pay so no money was involved) for his severely disabled son on emergency basis after his son was released from the hospital. The Sacramento jury sided with the Plaintiff, who was able to prove that Raley’s did not terminate Plaintiff for policy violations, but for Plaintiff’s use of his medical leave in order to take care of his disabled, wheelchair bound son.

$1,406,000 – Personal Injury – Negligence

Verdict in Kean v. BC Leasco, LP on behalf of a truck driver for BC Leasco, LP, who was sprayed with aqueous ammonia from the trailer on the tanker he had driven to a delivery site. Kean’s injury was a result of BC Leasco’s negligence in removing the safety flapper valve from the pump that had attached to the tanker.

Verdict in Jackson v Dr. Dominque Engle, on behalf of a patient against Dr. Engle, M.D., in which a lower back (L4-5) surgery was performed below the medical standard of care resulting in permanent injuries.

$674,191.00 –Whistleblower Retaliation

Verdict in Monk v. Sacramento Metropolitan Fire District on behalf of an arson investigator for the Sacramento County Fire District who was wrongfully retaliated against for reporting a subordinate who had falsified a report. Following Monk’s report he was suspended, written up, and demoted.

$400,000 –Physical Disability Discrimination/Retaliation

Verdict in Weyhe v. Wal-Mart on behalf of a disabled employee for Wal-Mart was subject to physical disability/medical condition discrimination, harassment, and retaliation. Weyhe required additional breaks due to his physical disability/medical condition, which Wal-Mart failed to accommodate. After he opposed and complained about the medical and/or physical disability discrimination, harassment, he was retaliated against and terminated from his employment.

$220,000 –Defamation

Verdict in Baker v. Buffington on behalf of an optometrist for Buffington Optometry. Baker resigned from Buffington, at which time Buffington gave Baker permission to contact his patients to inform them he was leaving and offered to refer any patients who asked for him. However, shortly after Baker left, Buffington ceased referrals and instead began defaming Baker, by telling patients that Baker stole Buffington’s patient lists.

Settlement on behalf of an older female plaintiff against a  national employer, where our client was harassed by her manager terminated upon her age.

Our clients were several females against a  large retail defendant, in which their manager committed sexual harassment in the form of inappropriate touching and unwelcome sexual comments.

Settlement obtained of behalf of a single female plaintiff against a large pharmacy, in which our client was subjected to sexual harassment amounting to a hostile work environment, in the form of inappropriate sexual comments and unwanted touching.

Settlement obtained on behalf of disabled client against a municipality, where plaintiff’s co-workers and supervisors engaged in constant harassment of plaintiff due to his disability.

Settlement on behalf of a single plaintiff against a food industry employer, where the regional manager made unwelcome sexual comments to our client.

$235,000 Age/Gender Harassment/Retaliation

Settlement obtained on behalf of a 58 year old, female plaintiff against a employer where co-workers her by making inappropriate comments regarding her age and gender. When our client complained about the harassment, she was retaliated against and terminated.

Settlement on behalf of our client against large employer where our client, a father of 3, was retaliated against and terminated for using his statutorily provided FMLA to care for his sick child.

$390,000 Whistleblower Retaliation

Settlement on behalf of a singled plaintiff against their employer, where our client was instructed by the defendant to engage in unfair business practices. Our client refused to engage in the unfair business practice and reported the unlawful conduct, our client was retaliated against and was terminated.

Settlement on behalf of our client against a large company, where our client had a slip and fall personal injury  when he slipped on some PVC pipe left out by a third party defendant, resulting in a Reflex Sympathetic Dystrophy injury to his elbow. We took the action out of the Workers' Compensation system and sued the third party defendant.
