What Does The Law Say?
The California Department of Fair Employment and Housing (DFEH) and the federal Age Discrimination in Employment Act (ADEA) both specify that employees or prospective employees cannot be discriminated against for their age when they are at least 40 years old.
DFEH spells out examples of illegal discrimination by public or private employers with five or more employees, including:
- Job advertisements that give a young age as a qualifier for a job
- Applications, screening and interviews of prospective employees
- Hiring, transferring, promoting, terminating or separating employees with a young age as a criterion
- Better working conditions, including compensation, for employees under age 40
- Offering opportunities to participate in training or apprenticeships, employee organizations or unions depending on youthful ages
